TERMS AND CONDITIONS OF SALE
ACCEPTANCE OF THE GENERAL CONDITIONS OF SALE

The contract (as defined: distance contract pursuant to art. 50 et seq. Of Legislative Decree September 6, 2005, n.206 "Consumer Code") entered into between Pepper Maremma and the Customer, shall be deemed concluded with the acceptance, even partial, by Pepper Maremma of a purchase proposal issued by the Customer, via the Internet, in the website http://www.peppermaremma.it. Such acceptance shall be deemed tacit unless otherwise communicated to the Customer by appropriate means.
By placing an order, the Customer declares: 1) that he/she is a consumer according to the provisions of art. 3 of the Consumer Code; 2) that he/she is of age; 3)that the data provided by him/her for the execution of the contract are correct and true; 4) that he/she has read all the information provided to him/her during the purchase procedure, and that he/she fully accepts the general and payment conditions indicated in the purchase procedure.
EXCLUSION OF LIABILITY. In the event of non-acceptance, even partial, of an order by Pepper Maremma any right of the Customer to damages or compensation is excluded, as well as any contractual or extra-contractual liability for direct or indirect damages to persons and/or property.

MODE OF PURCHASE

The Customer is guaranteed only and exclusively on the purchase of products in the electronic catalog of Pepper Maremma's online shop at the time of placing the order and viewable online at (URL) http://www.peppermaremma.it/shop. It is also specified that the images pertaining to the descriptive sheet of a product may, in some cases, not be perfectly distinctive of its characteristics but to differ in some particular cases, such as dimensions, colors, other particular accessories or details possibly presented in the picture.
PERFECTION OF THE CONTRACT. The contract is finalized by notifying the Customer (who has made a purchase proposal by providing the necessary data for the registration procedure of his name, purchase order and chosen payment method) that the proposal has been accepted. The correct receipt of the order is confirmed by Pepper Maremma through an e-mail response sent to the e-mail address provided by the Customer at the time of the order. The 'Customer Order Number' reported in the confirmation message together with the date and time of receipt of the order, will be used in any further communication with the Pepper Maremma online shop. The Customer undertakes to verify the correctness of all data entered in the manner described in this document and to promptly communicate any corrections.
NON-ACCEPTANCE. In the event of non-acceptance of the order, for any reason, Pepper Maremma guarantees timely notification to the Customer by email.
PRODUCT AVAILABILITY. All products for sale and in the electronic catalog of Pepper Maremma's online shop are available at the time of purchase, unless unforeseen unavailability of supply by the manufacturers and/or suppliers of Pepper Maremma's online shop, due to computer errors, stock breakage, unreported out of stock, non-delivery due to carrier strike, product nonconformity at the time of receipt and other causes not foreseeable at the time of order acceptance.
INVOICE. For each order placed on the online shop, if the Customer has expressly requested it at the time of the order in the 'Notes' and has provided valid VAT No. or valid CF when registering the Customer's Account, Pepper Maremma will issue an invoice for the material shipped, sending it via e-mail to the order holder.

DELIVERY OF PRODUCTS

Pepper Maremma accepts Customer's orders for both in-stock and out-of-stock quantities of existing products. Pepper Maremma agrees to promptly notify Customer of any unforeseeable out-of-stocks and the time required to receive goods not in stock. In order to maintain the efficiency of the service and if the conditions arise, Pepper Maremma reserves the right to use a different express courier than the one chosen by the Customer at the time of finalizing the order.
Pepper Maremma delivers the products to the address indicated by the Customer within the time provided by the shipping details by courier or in any case within 30 (thirty) days from the conclusion of the contract. No responsibility can be attributed to Pepper Maremma in case of delay in the fulfillment of the order or in the delivery of what has been ordered in case of failures or defaults on the part of the delivery courier.
DELIVERY CHARGES. Delivery costs are the responsibility of the recipient and explicitly highlighted when placing the order.
TIME OF DELIVERY. Upon delivery of the goods by the courier, the Customer is invited and still required to check:
That the number of packages actually delivered corresponds to the number indicated in the transport document;
that the packaging of packages is intact in every part, not damaged, nor compromised by atmospheric events or otherwise altered.
COMPLAINTS TO THE COURIER. Damaged products or mismatch of packages: any external damage or mismatch of the number of packages must be immediately contested to the courier by marking 'withdrawal with reservation' on the courier's accompanying document and must also be reported, within 3 days, by sending an email to info@peppermaremma.it.
NON-COLLECTION. In case of failure to collect within 5 working days of the material in storage at the warehouses of the courier due to repeated inability to deliver to the address specified by the customer when ordering, what was ordered will be returned to the warehouses of Pepper Maremma. Arrangements will be made for reshipment and additional shipping costs.

Right of withdrawal
The Customer's rights are protected by Legislative Decree 206/2005 as amended. The Customer has, therefore, the right to withdraw from the contract, even partially, without explanation and without charge, provided that the withdrawal is communicated by registered letter A/R to Pepper Maremma c/o Mineo Luca, Via Merloni 8, 58100 Grosseto, within 14 working days from the day of receipt of the products. The communication may be anticipated, within the same period, by e-mail (at info@peppermaremma.it) provided that it is confirmed by registered A/R within the next 48 hours. This communication must specify the will to withdraw from the purchase and the product or products for which it is intended to exercise the right of withdrawal. The Customer must then return the product at his own expense to Pepper Maremma, c/o Mineo Luca, Via Merloni 8, 58100 Grosseto
The right of withdrawal is valid except as stated in the following points:
the right applies to the product purchased by the Customer considering it in its entirety. It is not possible to exercise withdrawal only on part of the purchased product ( ex: accessories, attachments, moving parts, etc.).
the right of withdrawal does not apply to custom-made or personalized goods, or to goods that by their nature cannot be returned or are likely to deteriorate or alter rapidly (all plants, fruits and vegetables, and products with a shelf life of less than 60 days)
the purchased goods must be returned intact, complete in all its parts and packed in the original and complete packaging (including any documentation and accessory equipment).
In accordance with the law, shipping costs related to the return of the goods are the responsibility of the customer.
shipment, until the certificate of receipt in our warehouse, is the full responsibility of the Customer.
Pepper Maremma is not responsible in any way for damage or theft/loss of goods returned by uninsured shipments; in case of damage to the goods during transport, Pepper Maremma will notify the Customer of the incident (within 5 working days of receipt of the goods in its warehouses), to enable him to file a timely complaint against the carrier of his choice and obtain reimbursement of the value of the asset. In this case, the product will be made available to the Customer for its return, simultaneously canceling the request for withdrawal.
upon its arrival in the warehouse, will be evaluated any damage or tampering to the product, not resulting from normal transport procedures. if the packaging and / or the original packaging are damaged, Pepper Maremma will deduct a percentage from the refund due to the Customer. This percentage (to be understood as a contribution to the costs of restoration) can not be more than 10% of the same.
If the withdrawal has been exercised in accordance with the procedures described, Pepper Maremma will refund the amount paid for the purchase of the product within 14 days from the date of return of the goods. The amount refunded will be gross of delivery charges. Pepper Maremma will proceed with the reversal of the amount charged to the Credit Card or issue a Bank Transfer. In the latter case, it will be the customer's responsibility to promptly provide the bank details on which to obtain the refund (ABI - CAB - Current Account of the holder ).
FORFEITURE OF THE RIGHT OF WITHDRAWAL. The right of withdrawal is totally forfeited for lack of the essential condition of integrity of the goods (packaging and its contents), in cases where Pepper Maremma ascertains even only one of the following deficiencies:
The non-diligent use of the asset that has compromised the integrity, or the use of any consumables related to the product;
The lack of the original outer packaging and/or inner packaging;
The absence of integral elements of the product (accessories, parts, etc.);
damage to the product due to causes other than its transportation, including partial or total tampering with the product or parts of it.

Complaints
Goods must be verified upon receipt. Pepper Maremma is very attentive to the needs of its customers. Report any anomalies and disservices: missing ordered goods, unprofessional staff, unreliable couriers, etc. We will be ready to respond and solve your problems.
